ChatterBox Phone, LLC ("ChatterBox," "we," "us," or "our") is committed to protecting the privacy of our customers and their families. This Privacy Policy describes how we collect, use, disclose, and protect information when you use our Voice over Internet Protocol ("VoIP") telephone service, website, and related services (collectively, the "Service").

ChatterBox is designed for families with children. We take special care to protect information related to child users and comply with the Children's Online Privacy Protection Act ("COPPA") and other applicable privacy laws.

1. Information We Collect

1.1 Account Information

When you create an account, we collect:

  • Name and contact information (email address, phone number)
  • Billing address and payment information
  • Service address (physical location where phone will be used, required for E911)
  • Emergency contact information for 911 Alert notifications

1.2 Phone Configuration Information

When you set up phones on your account, we collect:

  • Phone labels/titles (which may include names you assign to devices)
  • Contact whitelist information (names and phone numbers you authorize)
  • Phone configuration and parental control settings

1.3 Call Records and Usage Data

As part of providing telephone service, we automatically collect:

  • Call detail records (CDRs): phone numbers called and received, date, time, and duration of calls
  • Voicemail recordings (when voicemail is enabled)
  • Service usage data and connection information
  • Device identifiers and IP addresses

1.4 Website and Portal Usage

When you visit our website or use the parent portal, we may collect:

  • Browser type and operating system
  • IP address and general location
  • Pages visited and actions taken
  • Cookies and similar tracking technologies

2. How We Use Information

We use the information we collect to:

  • Provide, maintain, and improve our telephone service
  • Route calls and provide E911 emergency services
  • Enable parental control features, including contact whitelists and call logging
  • Send 911 Alert notifications to your designated emergency contacts
  • Process payments and manage your account
  • Communicate with you about your service, including service announcements and support
  • Detect, prevent, and address fraud, abuse, and technical issues
  • Comply with legal obligations and regulatory requirements
  • Improve our services and develop new features

3. Children's Privacy

ChatterBox is designed for families with children. We are committed to complying with the Children's Online Privacy Protection Act (COPPA) and take special precautions to protect children's information.

3.1 Parental Consent

All ChatterBox accounts are created and managed by parents or legal guardians who are at least 18 years old. By creating an account, providing payment information, and activating service for your child, you acknowledge that you are the parent or legal guardian with authority to consent on behalf of the child who will use this service. Your continued subscription constitutes your verifiable parental consent to our collection, use, and disclosure of information as described in this Privacy Policy.

3.2 Information Collected from Child Users

The information we may collect that relates to child users includes:

  • Phone labels/titles assigned by parents (which may include a child's name)
  • Call detail records showing calls made and received from phone devices
  • Voicemail recordings (which may contain a child's voice)

3.3 Limited Use of Children's Information

We use information related to child users solely to provide the telephone service and enable parental monitoring features. We do NOT use children's information for marketing purposes, behavioral advertising, or any purpose other than providing the Service. We do NOT sell children's personal information for any purpose.

3.4 Parental Rights

As a parent or guardian, you have the right to:

  • Review the personal information we have collected about your child
  • Request deletion of your child's personal information
  • Refuse to permit further collection or use of your child's information
  • Revoke your consent by canceling the service

4. Customer Proprietary Network Information (CPNI)

As a telecommunications provider, we are subject to federal regulations regarding Customer Proprietary Network Information ("CPNI").

4.1 What is CPNI?

CPNI includes information about the telecommunications services you purchase from us, how you use those services, and related billing information. Your telephone number, name, and address are NOT considered CPNI.

4.2 How We Use CPNI

We use CPNI to provide and bill for telecommunications services, to protect against fraud, and for other purposes permitted by law. We do NOT use CPNI to market products or services to you.

4.3 Your CPNI Rights

You have the right to request information about what CPNI we hold about your account. Contact us at privacy@chatterboxphone.com to make a request.

4.4 CPNI Protection

We implement safeguards to protect CPNI from unauthorized access, including employee training, access controls, and security procedures. We will notify you and the appropriate authorities if we become aware of any breach of your CPNI.

5. How We Share Information

We do NOT sell your personal information, including information about children, to third parties for any purpose.

5.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including telecommunications carriers for call routing, payment processors for billing, and E911 service providers for emergency services. These providers are contractually obligated to protect your information and use it only for the services they provide to us.

5.2 Emergency Services

When you dial 911, we transmit your registered address, callback number, and other information necessary for emergency response to the appropriate Public Safety Answering Point (PSAP) and emergency services.

5.3 Legal Requirements

We may disclose information when required by law or in response to:

  • Valid subpoenas, court orders, or legal process
  • Requests from law enforcement agencies with proper legal authority
  • Government requests related to national security or emergency situations
  • FCC or other regulatory requirements

5.4 Business Transfers

If ChatterBox is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your information.

5.5 With Your Consent

We may share information for other purposes with your explicit consent.

6. Data Retention

We retain your information only as long as necessary to provide the Service and fulfill the purposes described in this Policy:

  • Account information: Duration of your service plus a reasonable period for account reactivation
  • Call detail records: 18 months, unless required longer by law
  • Voicemail recordings: Until deleted by you, or automatically after 90 days of inactivity
  • Billing records: As required by tax and financial regulations (typically 7 years)
  • Website usage data: 12 months

We do not retain personal information related to children indefinitely. Upon account termination, we delete or anonymize children's information within 90 days unless retention is required by law.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, use, or disclosure. These measures include encrypted data transmission, secure servers, access controls, and employee training. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

8.1 Access and Correction

You may access and update your account information at any time through the parent portal or by contacting customer support.

8.2 Data Deletion

You may request deletion of your personal information by contacting us. We will comply with your request within 45 days, subject to our legal obligations to retain certain records.

8.3 Communication Preferences

You may opt out of promotional communications by following the unsubscribe instructions in our emails. You cannot opt out of transactional communications related to your service (such as billing notices and service alerts).

8.4 Voicemail Management

You may delete voicemail recordings at any time through the parent portal. You may also disable voicemail entirely through your account settings.

9. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to Know: You may request information about the categories and specific pieces of personal information we have collected, the sources of that information, the purposes for collection, and the categories of third parties with whom we share it.
  • Right to Delete: You may request deletion of your personal information, subject to certain exceptions.
  • Right to Opt-Out of Sale: We do NOT sell personal information, so this right does not apply.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

10. Other State Privacy Rights

Residents of other states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, and Utah) may have similar rights to access, correct, delete, and opt out of certain data practices. Contact us to exercise your rights under applicable state law.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice on our website at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Policy.
